General Terms and Conditions of Business

 

01.) Scope

The following General Terms and Conditions (hereinafter referred to as GTC) in the version valid at the time of registration apply exclusively between the University of Klagenfurt (hereinafter referred to as AAU), the University Sports Institute (hereinafter referred to as USI) and the participant in connection with the registration/payment for a course or competition and participation in the courses or competitions. The USI does not recognise any deviating terms and conditions of the participant. By registering, the participant accepts the applicable GTC and undertakes to comply with these and the organisational instructions of the USI. The USI expressly reserves the right to amend the GTC in response to current events.

 

02.) Prices / tariff groups / categories of persons / dates

The prices stated for the courses (= course fees) are semester prices divided into 3 tariff groups. The tariff groups are assigned to categories of persons.

‘University-related persons’ are given preference through staggered registration, i.e. course registration is possible on the first course registration day. Alumni (graduates) of the University of Klagenfurt and all other academics can register 4 days after the first course registration day for ‘university-related persons’. All other persons have the opportunity to register for remaining places seven days after the first course registration day for ‘university-related persons’.

03.) Requirements for course registration

Only persons aged 18 or older are eligible to register for and participate in courses, provided they have a corresponding account at a university or university of applied sciences in Austria or are fully and correctly registered in the USI course management programme (M:USI).

Employees, students of an Austrian university/university of applied sciences and alumni of the University of Klagenfurt can log in using the access data of the respective institution. The required personal data (date of birth, telephone number, profile photo) must be added after the first login. The account can be used for booking immediately. For employees, the automatic tariff classification is based on the start and end of the contract (key date). For students, the automatic tariff classification is based on the corresponding student status.

All other persons can register online or at the USI Secretariat during opening hours by providing the required data and presenting the necessary documents (first name, surname, academic degree if applicable degree or alumni certificate, date of birth, residential address, valid email address, photo (image file), relevant proof of identity, proof of disability if applicable).

 

All participants are responsible for ensuring that their classification is correct. If corrections to the tariff group and person category are necessary, please contact us at usi@aau.at in good time before registering for the course (the relevant proof must be provided). If you have any questions or concerns, please contact the Secretariat. Complaints after payment has been made will generally not be considered.

Please note that due to the increased workload at the start of course registration, delays in processing are to be expected.

 

04.) Course registration / course payment

A legally binding course registration is only valid after full payment of the course fee and receipt / printout of the booking confirmation.

Note: People with disabilities also have the option of participating in courses other than those specifically offered for them after consultation with the respective course instructor. USI courses are group training sessions in which the course instructors are specialists in their respective fields.

Additional costs:

For some courses, additional costs (e.g. for travel to and from the course location, equipment, admission, rental fees, lift tickets, materials, venue fees, accommodation, documentation, meals, etc.) may be incurred in addition to the course fee, which must be paid separately by the participant. Please note the relevant information for each course.

Course registration and payment online:

Students and employees of Austrian universities/universities of applied sciences as well as alumni of the University of Klagenfurt select their respective institution and log in with their user data.

All other persons must log in at: ‘Login for users with USI access data’

using the email address stored at the USI.  An unknown password can be requested accordingly.

The course fee can be paid by credit card (secure code required) or EPS (online banking, via your bank's portal – Austrian banks only).

Please always bring a booking confirmation with you. This can be in printed or digital form, after which you can participate in the course.

Course registration and payment at the USI Secretariat:

Course registration can be made at the USI Secretariat, Universitätsstraße 63, 9020 Klagenfurt, during the Secretariat's opening hours by cash or debit card payment (in person or through a trusted representative).

In order to speed up the process on site, we ask individuals (students and employees of a university/university of applied sciences) to log in to the course booking software M:USI (https://usi-sportangebot.aau.at/login/index.php) immediately before visiting the USI Secretariat in person. Only then will the current status (student/employee) be updated and the discounted rate can be applied. Alternatively, appropriate proof must be carried or a login must be carried out on site.

 

05.) Carrying/presenting the booking confirmation / prohibition of disclosure to third parties

All participants must carry their booking confirmation with them at all times. You can find the booking confirmation at https://usi-sportangebot.aau.at/my/, ‘My courses’, ‘Booking confirmation’.

Participants are obliged to present the booking confirmation to hall attendants, course instructors and other control personnel employed by USI upon request.

The booking confirmation is valid exclusively for the person named on it and the course specified on it. Participants are not entitled to pass on the booking confirmation to other persons for course attendance.

In the event of unauthorised participation in a course, the course instructor or supervisor is authorised to demand that the participant leave the training facility immediately. Any misuse of any kind will result in the immediate withdrawal of the booking confirmation and immediate suspension from all sports activities for a period of at least two semesters. The course fee will not be refunded. Furthermore, the USI reserves the right to take further legal action.

 

06.) Trial sessions

Participation in courses without course registration (‘trial sessions’) is only possible for courses that take place weekly over an entire semester in the first lesson with the consent of the respective course instructor.

For fully booked courses and courses of the following types: camps, holiday programmes, semester/seasonal subscriptions, specials, competitions, blocked courses/workshops, Try USI, events, trial participation is not possible.

 

07.) Cancellation/withdrawal/rebooking

 

7.1 Cancellation: USI courses can be cancelled within the respective cancellation period:

• In person during the opening hours of the USI Secretariat on the 2nd floor of the USI, Universitätsstraße 63, 9020 Klagenfurt

• By cancelling independently via your online account

The cancellation fee is €5 in each case.

The remaining amount will be credited to your account. If you wish to request a refund, please submit the form ‘Request for Refund’ (see USI website) to usi@aau.at.

No refunds will be made after the relevant date.

A distinction must be made between: semester weekly courses, block courses/workshops, holiday programmes, camps, specials, Try USI, semester/season subscriptions, competitions and events.

 

7.1.1 Semester weekly courses: These take place weekly during the semester at the University of Klagenfurt (except on public holidays and during holidays) and are identified as the corresponding course type. Cancellation is only possible within the cancellation period. The end of the cancellation period is 11:59 p.m. on the Sunday after the first week of the course each semester.

 

7.1.2 Blocked courses/workshops, holiday programme and Try USI: These are listed in the course programme as the corresponding course type or marked with the corresponding ‘tag’. The respective start and end dates are indicated separately. They are held on one or more days (usually at weekends). Workshops can be booked up to 7 weekdays before the start of the event and cancelled no later than 21 weekdays before.

 

7.1.3 Camps: Courses with blocked teaching time and overnight accommodation are assigned to the corresponding course type and have a separately indicated start and end date. Camps have different requirements, which is why the corresponding cancellation deadlines can be found in the respective camp description. We would like to point out that no costs (neither course fees nor accommodation costs) will be refunded in the event of early departure or late arrival. Courses may be rescheduled or cancelled due to weather conditions (lack of snow, lifts not operating). We recommend that you take out private cancellation insurance.

A cancellation fee of €5 will be charged up to the cancellation date specified in the course description. If cancellation occurs after this date, the entire course fee must be paid.

 

7.1.4 Semester and season passes: Allow use of the corresponding infrastructure for a specified period or frequency.

Cancellation of semester and season passes is possible in accordance with 7.1.1.

 

7.1.5 Competitions/events/specials: Are listed in the course programme as the corresponding course type. The competition is usually held on a specific date. Registration for championships is possible up to 7 weekdays before the start of the event and can be cancelled no later than 21 weekdays before the event.

 

7.2 Withdrawal: A right of withdrawal only exists if no specific date or period for the course is specified when the contract is concluded. In this case, the deadline is 14 days from the date of conclusion of the contract and can be done:

• In person during the opening hours of the USI Secretariat on the 2nd floor of the USI, Universitätsstraße 63, 9020 Klagenfurt

• By email to usi@aau.at: by means of a declaration of withdrawal (including your full first and last name, the email address of your online account, the course number(s) and, if you wish to receive a refund, the corresponding form ‘Application for refund’ (see USI website)

• By cancelling independently via your online account

 

The cancellation fee is €5 in each case.

The remaining amount will be credited to your account. If you wish to receive a refund, you can initiate this by sending the form: ‘Application for refund’ (see USI website) to usi@aau.at.

No refunds will be made after the relevant date.

 

7.3 Rebooking: It is possible to rebook a semester weekly course:

• Independently in your personal online account using the ‘Rebook course’ button, in person or with power of attorney and ID during the opening hours of the USI Secretariat on the 2nd floor of the USI, Universitätsstraße 63, 9020 Klagenfur. There is no processing fee within the cancellation period; after the end of the cancellation period, the fee is €2 per rebooking transaction. A transfer to a semester course that is not fully booked is possible until the end of the third week of the course and is permitted a maximum of three times per semester. When transferring to a more expensive course, the difference in price must be paid (in addition to the processing fee). When transferring to a cheaper course, no refund or credit note is possible after the cancellation deadline.

In any case, for blocked courses, camps, events and competitions, additional cancellation fees will be charged for flights, accommodation, etc. or any other resulting costs. These cancellation conditions can be found on the website of the respective airline, accommodation provider, etc. We recommend taking out private cancellation insurance.

Please note that in the case of blocked courses, workshops, camps, events and competitions, no costs (neither course or cancellation fees nor accommodation costs or similar) will be refunded in the event of early and/or late arrival and/or departure.

It is not possible to initiate deregistration, cancellation, withdrawal or rebooking by telephone.

For blocked courses, camps, events and competitions marked as ‘binding registration’, cancellation with a refund of the course fee or credit note is not possible and additional cancellation fees, e.g. for flights, accommodation, etc., will be charged. These cancellation conditions can be found on the website of the respective airline, accommodation provider, etc. We recommend taking out private cancellation insurance.

Health reasons (such as injuries, illnesses, pregnancy) or other reasons are not grounds for cancellation or withdrawal from semester week courses, blocked courses, workshops, holiday programmes, camps, specials, Try USI, events and competitions, or semester/season subscriptions. In these cases, the course fee will neither be refunded nor credited.

 

We therefore strongly recommend taking out private health/accident/liability insurance.

 

08.) Course cancellation / course cancellation / course postponement

The USI reserves the right to cancel courses below the specified minimum number of participants due to unavailability of premises, absence of the course instructor, weather conditions or unforeseeable external circumstances (e.g. pandemic). Participants will be notified of this cancellation immediately in writing by email. In such cases, the course fee will be credited proportionally under the registration. This credit can be redeemed when registering for the next online course. Upon request, a refund can be arranged free of charge by sending the appropriate form ‘Application for refund’ (see USI website) to usi@aau.at.

 

Course cancellations or postponements (e.g. due to holidays, public holidays, days without classes, illness/quarantine of the course instructor, gym repairs, school-autonomous hall closures, competitions, short-term closure of sports facilities for safety reasons, extreme weather conditions, registration for personal use, etc.) do not entitle participants to a full or partial refund of the course fee or replacement times for the course units.

 

09.) Hybrid courses

These are events that are simultaneously broadcast live online in addition to being held in person and are also available on demand. Participants are free to choose how they wish to participate. If it is not possible to hold in-person sessions due to exceptional circumstances, the course will continue exclusively online. In such cases, refunds are not possible.

Short-term technical problems with live broadcasts or missing recordings in the ‘on demand’ offer do not entitle participants to a refund.

 

10.) Online courses

These are events that are broadcast live exclusively online and are also available on demand. Short-term technical problems with live broadcasts or missing recordings in the ‘on demand’ offer do not entitle participants to a refund.

 

11.) Try USI

Try USI courses are weekly courses that can be booked at a reduced price during the last weeks of the respective semester. Additional places are available for courses that are fully booked. Courses for which Try USI is available are marked with the corresponding ‘tag’ in the course programme and can be filtered.

 

12.) Notification list (or waiting list) for fully booked courses

For fully booked courses, a bell icon appears instead of the shopping cart. This allows you to be placed on a notification list. If a place becomes available on a course, everyone on the notification list will receive a message. There is no ranking within the notification list. Places that become available are allocated on a first come, first served basis.

 

13.) Programme changes / changes to services

The USI reserves the right to make price changes, programme changes and changes to the range of courses that are objectively justified. This excludes the possibility of contesting the agreement on the grounds of error. Please note the information provided for each course on the homepage.

 

14.) Course place reservations

Course place reservations cannot be made online or via the USI office!

 

15.) Use of sports halls/sports facilities

Participation in sports lessons requires appropriate sports equipment. All participants are requested to wear sports shoes with clean, light-coloured or abrasion-resistant (hard) soles. Hall attendants or other USI staff are authorised to carry out checks and to demand immediate departure from the training facility in the event of non-compliance. Equipment and facilities may only be used as part of a course in the presence of the course instructor; the instructions of the staff must be followed at all times.

Participants and course instructors must leave the building no later than 15 minutes after the course venue closes.

 

16.) Sports medical examination

Due to the sometimes high demands placed on the body by the sports units, we recommend a sports medical examination. Participation is at your own discretion and is in any case at your own risk.

 

17.) Further information on participation

By registering, participants confirm that they have informed themselves sufficiently that they meet the physical and health requirements for the respective course, competition or free training (subscription). If the participant does not meet the requirements of a course due to insufficient personal ability or sports equipment that is not suitable for the sport, the course instructor has the right to exclude the participant from the course. The course fee will not be refunded or credited in this case. If the participant is excluded from the course for disciplinary or hygienic reasons, the course instructor must inform the participant of this on the booking confirmation by means of a note.

Confirm date and signature. In this case, the course fee will be refunded in full within 7 working days of exclusion from the course at the USI Secretariat during the designated office hours.

 

If any additional costs (additional costs, cancellation fees for flights, accommodation, etc. or other costs) are not paid by the participant, this will result in immediate suspension from participation in all sports activities for a period of at least two semesters. In this case, the course fee will not be refunded.

Course participation must be in accordance with the AAU house and usage regulations (http://www.aau.at/) and the USI usage rules (http://www.aau.at/usi/). Repeated violations of these rules or other safety regulations will result in exclusion from all sports activities for a period of at least two semesters. In this case, the course fee will not be refunded.

 

18.) Loss/damage of locker keys/locks

In the event of loss/damage to locker keys/locks, the costs incurred by the USI must be reimbursed. A form for reporting loss/damage, available from the USI hall attendant, must be completed accordingly.

 

19.) Personal data

Participants undertake to keep the email address provided during registration up to date at all times.

All course-related information, in particular regarding course cancellations, date changes or organisational adjustments, will be communicated exclusively by email.

The USI accepts no responsibility for any disadvantages arising from an outdated or incomplete email address. Personal data can be updated at any time after logging in (https://usi-sportangebot.aau.at/login/index.php). Falsifying your identity will result in immediate and permanent exclusion from all sports activities. In this case, the course fee will not be refunded. Furthermore, the USI reserves the right to take further legal action.

 

20.) Data protection

The participant agrees that the data provided by him/her may be stored and processed for the purposes of accounting, participant registration and notifications by email in the event of course cancellations or changes, USI events and the like. For the execution and processing of camps, events and competitions (courses of the course type: camps, events and competitions), personal data will be forwarded to the respective airline, accommodation provider, etc. for organisational purposes. The stored personal data can be deleted on request, provided that no other legal retention period prevents this. Further use of the USI services is no longer possible after the personal data has been deleted.

By registering, the participant agrees to the publication of photos and videos taken during the use of the University Sports Institute. They will be used for advertising and reporting by the University Sports Institute (print and online). The consent remains valid without time limitation, but can be withdrawn or restricted at any time. The revocation applies to all future publications, but not to those that have already been made.

 

21.) Disclaimer

Please note that the USI does not take out any insurance for its participants (through course registration or registration for competitions, events).  Participation in courses, competitions and events and the use of USI facilities and equipment or sports facilities rented by the USI is strictly at your own risk. The USI or the owner of the premises accepts no liability for accidents, illness, theft, loss of personal belongings or damage of any kind. The USI's liability is limited to intent and gross negligence. In the event of accidents and injuries, participants must claim on their own health/accident/liability insurance. We therefore strongly recommend that participants take out private health/accident/liability insurance. This is confirmed and acknowledged by registering for courses or academic competitions and events.

22.) Applicable law

Austrian law applies.

 

23.) Place of jurisdiction

The competent court in Klagenfurt is agreed as the exclusive place of jurisdiction.
